DBS Check UK: Types, Eligibility, Processing Times & Employer Rules (2026)
A DBS check is a criminal record check issued by the Disclosure and Barring Service, a Home Office body that helps employers make safer hiring decisions. Over 7 million certificates are issued every year, yet many employers still request the wrong type, misread results, or miss their legal duties when a record comes back. But high usage does not mean high understanding. Many employers request the wrong type. Many misread what a certificate actually shows. Many do not know their legal duties once a result comes back.
For organizations hiring into positions of trust, DBS checks are no longer just an administrative formality. They have become a critical part of safeguarding, compliance, and workforce risk management especially in sectors such as healthcare, education, financial services, and social care. At DE RISC Group, we support organizations across these sectors with fully managed DBS check services, helping employers stay compliant, reduce risk, and make safer hiring decisions from day one.
This guide covers every practical and legal aspect of DBS checks in the UK as of 2026 for employers, HR teams, and individuals.
What Does a DBS Check Show?
A DBS certificate does not give a pass or fail result. It discloses information the employer then decides whether that information is relevant to the specific job.
The Four Types of DBS Checks

The correct level depends on the role, not employer preference.

Roles involving regulated activity |
Key 2026 update: From 21 January 2026, self-employed workers — such as private tutors, independent carers, and personal coaches can now apply for Enhanced checks through a registered umbrella body. Before this, they could only access a basic check.
The barred lists as of March 2025:
- Children's Barred List — 91,015 people
- Adults' Barred List — 69,900 people
It is a criminal offence for a barred person to carry out regulated activity. It is equally an offence for an employer to knowingly allow them to do so.
What Is Regulated Activity?
Regulated activity means specific types of work where the risk of harm is high enough to require the highest level of screening. It is defined under the Safeguarding Vulnerable Groups Act 2006.
- For children: teaching, training, supervising, or caring for children on a regular or intensive basis, and any role in a school or childcare setting.
- For adults: providing health or social care, personal care, or help with financial matters in a formal care setting.
If a role involves regulated activity, an Enhanced DBS check with barred list search is a legal requirement not optional.
Who Needs a DBS Check?
There is no UK law requiring every job to have a DBS check. However, many sectors are legally required to screen workers before placing them in certain roles, including:
- Direct work with children or vulnerable adults
- Healthcare (doctors, nurses, paramedics, pharmacists)
- Legal and financial roles (solicitors, financial advisors)
- Sensitive settings (schools, hospitals, prisons, children's homes)
The most common employer mistake: requesting a higher level of check than the role legally allows. This is unlawful regardless of internal preference.
Workforce Types — Getting This Right Matters
The workforce type is a required field on every DBS application. Getting it wrong can invalidate the entire application.
|
Workforce Type |
Who It Covers |
|
Child Workforce |
Roles involving work with children under 18 |
|
Adult Workforce |
Roles in healthcare or social care with vulnerable adults |
|
Child and Adult Workforce |
Roles involving both groups (e.g. A&E nurses, family counsellors) |
|
Other Workforce |
Roles needing a check without direct contact with vulnerable groups |
The DBS provides a free eligibility tool on GOV.UK to confirm the correct check level and workforce type.
How Long Does a DBS Check Take in 2026?

|
Check Type |
Average Time |
Possible Range |
|
Basic |
0.8 days |
Up to 14 days |
|
Standard |
1.5 days |
1–5 working days |
|
Enhanced |
14 days |
Up to several weeks |
You cannot pay to speed up a DBS check. The DBS does not offer a priority service. Any third-party website suggesting otherwise is misleading.
Why do enhanced checks get delayed? Most delays happen at Stage 4, where the application goes to a local police force for manual review. Common causes include: multiple addresses in the past five years, high-volume forces like the Metropolitan Police, errors on the form, or paper applications (which are consistently slower than online ones).
If an application has not come back after 28 days, it becomes an aged case. Employers can escalate directly to the DBS at customerservices@dbs.gov.uk.
Does a DBS Check Expire?
No. A DBS certificate has no official expiry date but it only reflects records on the day it was issued. Most employers set their own rechecking schedules, commonly every one to three years.
The DBS Update Service
The Update Service is an annual subscription that keeps a certificate current, allowing employers to run instant, free status checks online without a full new application each time.
How it works:
- The applicant subscribes within 30 days of their certificate being printed
- Employers run a free online status check at any time, with the applicant's consent
- Since December 2024, subscribers get an email reminder 30 days before renewal
Important: A status check is only valid when the check type and workforce type on the stored certificate match the new role. An enhanced check for a child workforce role cannot cover an adult workforce role.
Does a DBS Check Cover Overseas Convictions?
No. A UK DBS check only searches records held within the UK. Offences committed abroad will not appear. For candidates who have lived or worked overseas, employers should request a separate overseas criminal record check often called a Certificate of Good Conduct or Police Clearance Certificate from the relevant country.
Legal Duties for Employers
|
Duty |
What It Means |
|
Request the right level |
Only the level the role legally qualifies for — going higher is unlawful |
|
Certificate goes to the applicant first |
The DBS sends it to them; employers must ask to see it |
|
Assess, don't auto-reject |
Consider what the offence was, when it happened, and whether it is relevant to the role |
|
Written ex-offenders policy |
Required for all DBS-registered organisations; good practice for all |
|
Handle data correctly |
Store securely, use only for its intended purpose, keep for no longer than six months |
Can you fail a DBS check? No. A DBS check does not produce a pass or fail result. It discloses criminal record information. The employer then assesses whether that information is relevant to the role.
Can self-employed people get a DBS check? Yes. As of 21 January 2026, self-employed individuals can apply for Enhanced and Enhanced with Barred Lists checks through a registered umbrella body. A basic check has always been available to apply for directly.
Does a DBS check show overseas offences? No. It only covers records held in the UK. A separate overseas criminal record check is needed for candidates with time spent living or working abroad.
Why is my enhanced DBS check taking so long? The most common reason is a manual police review at Stage 4, particularly where an applicant has lived in multiple areas or the application was submitted to a high-volume force.
Can employers keep a copy of a DBS certificate? Yes, but only for up to six months, stored securely, and used only for the purpose it was obtained in line with UK data protection law.
What happens if a DBS certificate is lost? The DBS issues one original certificate to the applicant. If it was never received, a free reprint can be requested within 93 days of issue. No replacement is issued for certificates lost after delivery.
Does a DBS check affect your credit score? No. Criminal record information does not appear in credit reports. A DBS check has no effect on a credit score.
